At Meringo Sun, we value clarity and want you to feel confident when shopping with us.

These Terms & Conditions (“Terms”) explain the terms that apply when you visit www.meringosun.au, purchase or pre-order products from us, shop with us at markets or events, make a wholesale purchase, or otherwise use the services provided by Meringo Sun.

Throughout these Terms, “Meringo Sun”, “we”, “us” or “our” refers to Meringo Sun, ABN 11 972 401 662.

By using our website or placing an order with us, you agree to these Terms.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law, or any other right that cannot lawfully be excluded, restricted or modified.

1. Our website

We want www.meringosun.au to be a welcoming and useful place to discover and purchase Meringo Sun.

You must not use the website:

• for unlawful or fraudulent purposes
• to interfere with the operation or security of the website
• to introduce malicious software or code
• to attempt to gain unauthorised access to our systems or customer accounts
• to infringe another person's intellectual property or other rights
• in a way that could damage Meringo Sun, our Website or other users

We may restrict or suspend access where reasonably necessary to protect our website, customers or business.

2. Products

We make reasonable efforts to describe and photograph Meringo Sun products accurately.

Colours may appear slightly different depending on your screen, lighting and device settings.

Measurements and size guides are provided to help you choose your size. Every body is unique, so measurements and fit information are intended as a guide.

Product availability, colours, sizes, designs and specifications may change from time to time.

Nothing in this section limits your rights where a product does not correspond with its description or otherwise fails to comply with a consumer guarantee under the Australian Consumer Law.

3. Prices

Unless otherwise stated, prices displayed on the Australian version of www.meringosun.au are in Australian dollars (AUD).

Where GST applies, displayed consumer prices will include GST as required by Australian law.

Delivery charges and other applicable costs will be displayed before you complete your purchase.

We may change our prices from time to time. A subsequent price change will not normally affect an order we have already accepted.

If an obvious pricing, product or technical error occurs, we may contact you before accepting or fulfilling the affected order.

4. Placing an order

When you submit an order through www.meringosun.au, you are offering to purchase the products in your cart on the terms and information presented to you at checkout.

You must provide accurate and complete information, including your name, contact details, delivery or pickup information and payment details where required.

After placing an order, you will receive an acknowledgement or confirmation using the contact information you provided.

We may need to decline or cancel an order where, for example:

• a product is unavailable
• an incorrect price or product description was displayed
• payment cannot be authorised
• we reasonably suspect fraud or misuse
• an order exceeds applicable purchasing limits
• we cannot lawfully complete the transaction

If we cancel an order after receiving payment, we will refund the amount paid for the cancelled product or order as appropriate.

5. Per-Order Terms

In addition to these general Terms, each order may be subject to specific terms and information presented to you in connection with that particular purchase (“Per-Order Terms”).

Per-Order Terms may include:

• the products, sizes, colours and quantities selected
• the price payable
• whether a product is in stock or available for pre-order
• any applicable pre-order price or promotional price
• estimated production or dispatch dates
• shipping charges
• free-shipping thresholds
• delivery method
• local pickup arrangements
• promotional or discount-code conditions
• product-specific information
• any clearly disclosed purchasing limits
• other conditions clearly presented before you complete your order

The Per-Order Terms shown to you when you place your order form part of the agreement between you and Meringo Sun for that order.

Your order confirmation may also record relevant Per-Order Terms for your reference.

Changes between releases

Meringo Sun may offer different prices, shipping promotions, pre-order arrangements, products or other conditions at different times.

For example, a pre-order release may have a different price or free-shipping threshold from a later live-sale release.

Unless otherwise stated or required by law, the Per-Order Terms applicable to your purchase are those presented to you when you place that order.

A later promotion or change in price does not automatically apply retrospectively to an earlier completed order.

Likewise, the expiry of a promotion after you have placed an eligible order does not retrospectively remove the promotion from that order.

Inconsistency with these Terms

If a clearly stated Per-Order Term is intended to vary a general commercial term in these Terms for a particular order, the Per-Order Term will apply to that order to the extent of the inconsistency.

However, no Per-Order Term overrides:

• your rights under the Australian Consumer Law
• another right that cannot legally be excluded or restricted
• an express provision of these Terms that states that it cannot be varied by a Per-Order Term

We will not use Per-Order Terms to retrospectively impose additional charges or materially disadvantage you after an order has been accepted.

6. Payment

Payment must be made using one of the payment methods available at checkout.

Payments may be processed through Shopify or a third-party payment provider.

By submitting payment details, you confirm that you are authorised to use the selected payment method.

Unless otherwise clearly stated before purchase, payment is taken when you place your order, including for pre-orders.

7. Pre-orders

Some Meringo Sun products may be offered for pre-order before they are available for immediate dispatch.

Pre-orders are subject to our Pre-Order Terms, these Terms and any applicable Per-Order Terms displayed before purchase.

The relevant product page and checkout will identify a product as a pre-order where applicable and should provide the expected production or dispatch timeframe.

Estimated production and dispatch dates are estimates rather than guaranteed delivery dates unless we expressly state otherwise.

If there is a significant change to an expected pre-order dispatch timeframe, we will contact affected customers.

8. Shipping and local pickup

Shipping, delivery and local pickup are governed by our Shipping, Delivery & Local Pickup Policy, together with any applicable Per-Order Terms.

Please check your delivery information carefully before submitting your order.

Where local pickup is offered, the relevant pickup instructions will be provided once your order is ready.

9. Returns, exchanges and refunds

Our Returns, Exchanges & Refund Policy explains Meringo Sun's voluntary change-of-mind arrangements and how to contact us about faulty, damaged or incorrect products.

Nothing in that policy, these Terms or any Per-Order Terms limits your rights under the Australian Consumer Law.

10. Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law where that law applies.

These include guarantees that goods will, among other things:

• be of acceptable quality
• be fit for any purpose that you made known to us and we agreed they were suitable for
• match their description
• correspond with any applicable sample or demonstration model

Your remedy for a problem will depend on the circumstances and whether a failure is major or minor under the Australian Consumer Law.

Meringo Sun's voluntary returns, exchange and other customer-care policies operate in addition to, and do not replace, these rights.

11. Promotions and discount codes

From time to time, Meringo Sun may offer discount codes, pre-sale pricing, promotions or other offers.

Additional terms may apply to an individual promotion and, where applicable, form part of the Per-Order Terms.

Unless otherwise stated:

• promotions cannot be exchanged for cash
• discount codes cannot be applied retrospectively
• only one promotional code may be used per transaction
• promotions are subject to their stated dates, conditions and availability

We may refuse or cancel the use of a promotion where we reasonably believe it has been obtained or used fraudulently or contrary to its published conditions.

Nothing in this section affects rights that cannot legally be excluded.

12. Reviews and customer content

We love seeing where Meringo Sun goes with you.

If you submit a review, photograph or other content to Meringo Sun, you confirm that the content is yours or that you have permission to provide it.

Submitting a product review does not, by itself, give Meringo Sun unrestricted permission to use your photographs or other content in advertising. Any broader use will be subject to the permission or licence obtained from you.

Reviews may be moderated for matters such as:

• spam or fraudulent content
• offensive or unlawful material
• personal information
• content unrelated to the relevant product
• other content that does not comply with our reasonable review guidelines

We will not suppress a genuine review simply because the customer has provided a negative rating or opinion.

13. Community contributions

Meringo Sun may run initiatives through which we contribute money to selected community organisations.

Where an initiative applies, we will explain the relevant contribution and, where applicable, the opportunity for customers to nominate a participating organisation.

A customer's selection of a community organisation does not mean the customer is making the donation unless we expressly state otherwise.

Meringo Sun is responsible for making any contribution that we have promised as part of the applicable initiative.

14. Intellectual property

Unless otherwise stated, the Website and its content—including the Meringo Sun name, branding, logos, product designs, photographs, graphics, written content and other original material—are owned by or licensed to Meringo Sun.

You may browse and use the Website for personal, non-commercial purposes.

You must not reproduce, distribute, modify, commercially exploit or otherwise use our intellectual property without permission except where permitted by law.

15. Third-party services and links

Our Website may use or link to services operated by third parties, including payment, delivery, social media and technology providers.

Those organisations may operate under their own terms and privacy practices.

16. Privacy and marketing

We handle personal information in accordance with our Privacy Policy.

If you choose to receive marketing emails or SMS messages from Meringo Sun, you can unsubscribe using the method provided in the relevant communication.

SMS marketing is also subject to our SMS & Mobile Messaging Terms & Conditions.

17. Website availability

We work to keep meringosun.au accurate, secure and available, but we cannot guarantee that the Website will always operate without interruptions or technical errors.

We may update, maintain, suspend or change parts of the Website where reasonably necessary.

18. Liability

Nothing in these Terms excludes, restricts or modifies a consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified.

To the extent permitted by law, Meringo Sun is not responsible for loss caused by circumstances outside our reasonable control or by misuse of a product contrary to its intended use or care instructions.

Any exclusion or limitation in these Terms applies only to the extent permitted by applicable law.

19. Changes to these Terms

We may update these Terms from time to time to reflect changes to our Website, products, operations or legal obligations.

The current version will be published on meringosun.au with its last-updated date.

Unless otherwise required by law, changes to these general Terms will not retrospectively alter the agreed Per-Order Terms of an order already accepted by Meringo Sun.

20. Governing law

These Terms are governed by the laws of New South Wales, Australia and applicable Commonwealth laws.

Nothing in this section limits any right you may have to bring a claim in another jurisdiction where applicable law gives you that right.
